Wedding Photography Terms and Conditions


In the following terms & conditions “the photographer” shall mean Paul Murphy trading as P D Murphy Photography. “The client(s)” shall be those persons defined as bride or groom on the booking form. These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.

Copyright

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright, Designs and Patents Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer/s in writing. Our clients can however reproduce, print, display our photos for personal use.

Website Display & Promotional Usage

The client(s) need to fill out a model release form to allow the photographer to display any photographs covered by this contract to generally promote the business in advertising, social media platforms, magazine articles, websites, sample albums etc.

If agreed the photographer will aim to keep these photographs safe from any malicious activity but cannot be held liable or accountable for malicious actions carried out by other persons. The clients can revoke this model release agreement at any time by contacting the photographer by email at pdmphotography@hotmail.com

Force Majeure or Act of God

The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.

Law

These Terms and Conditions shall be governed and construed in accordance with the Laws of the United Kingdom.

Liability

The Photographer shall not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit. Where work is defective for any reason, including negligence, the photographer’s liability (if any) shall be limited to rectifying such defect.

Personal Accident Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

Licence

The Photographer shall be granted artistic licence in relation to the poses photographed, the location used and digital retouching. The Photographers’ judgement regarding the locations, poses and number of photographs taken shall be deemed to be correct.

Photographs and Images

All photograph and image sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. In the case of part mono/part colour images, the colours used will be subject to the photographer’s artistic interpretation and will be deemed to be correct. All photographs supplied by P D Murphy Photography are produced to the highest standards using the best quality materials and latest processing techniques. However, all photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass. P D Murphy Photography cannot accept any responsibility for this gradual image deterioration. All pictures purchased are presumed to have been received in good condition unless the Client notifies P D Murphy Photography in writing of any discrepancy or error within 14 days of receipt.

Booking Fee

A non-refundable booking fee of £100 is charged when the client agrees this contract, this fee is deducted (in full) from the total price. The booking fee secures the time and services of the photographer for the wedding and is non-refundable or transferable in the event of cancellation.

Payment

The package fee must be paid no later than 4 weeks prior to the wedding. Delays in payment will result in the cancellation of this contract. Please see below for further information regarding cancellations.

Cancellation

Cancellation less than 12 weeks prior to date of the wedding will result in payment in full for the complete photographic coverage booked. Where no package has been specified on the booking form, it will be deemed that the client(s) have chosen a package to the value of £1000.00.  The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation. All cancellations must be in writing. When a wedding has been postponed (rather than cancelled) to a later date the photographer will retain the fee as long as the photographer can re-schedule for the new date and time. Where the photographer is able to re-book the date with an equivalent booking then the cancellation fee will be reduced to the original booking fee.
Prices All services and/or goods are supplied at the current prices ruling at the time of each individual payment and are subject to change without prior notice. The photographer is not VAT registered so VAT is not quoted (nor is it charged).

Refund Policy

The photographer will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions.

Retouching

Retouching and artist finishing is available as an optional extra and the final output and finish of any image that is re-touched will be at the photographer’s discretion.
Storage of Images Original digital images are kept on an active file for one months, after which time the raw images are stored in a secure location (access to these images is solely limited to the photographer). Raw image files are deleted after one month after the photographer has show the client the final photographs.

Complaints

Any complaints should first be raised by the client with the photographer in writing within 14 days from the date of receipt of images.

What information do we collect?

We may collect, store and use the following kinds of personal information:

(a) information about your computer and about your visits to and use of this website (including your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and website navigation);

(b) information relating to any transactions carried out between you and us on or in relation to this website, including information relating to any purchases you make of our goods or services.

(c) information that you provide to us via the booking form/internet

(d) any other information that you choose to send to us


Cookies

A cookie consists of information sent by a web server to a web browser, and stored by the browser. The information is then sent back to the server each time the browser requests a page from the server. This enables the web server to identify and track the web browser. We may use both “session” cookies and “persistent” cookies on the website. We will use the session cookies to: keep track of you whilst you navigate the website. We may use the persistent cookies to enable our website to recognise you when you visit. Session cookies will be deleted from your computer when you close your browser. Persistent cookies will remain stored on your computer until deleted, or until they reach a specified expiry date. We use Google Analytics to analyse the use of this website. Google Analytics generates statistical and other information about website use by means of cookies, which are stored on users’ computers. The information generated relating to our website is used to create reports about the use of the website. Google will store this information. Google’s privacy policy is available at: http://www.google.com/privacypolicy.html. Most browsers allow you to reject all cookies, whilst some browsers allow you to reject just third party cookies. Blocking all cookies will, however, have a negative impact upon the usability of many websites.







Using your personal information

Personal information submitted to us via the booking form or online communication will be used for the purposes specified in this privacy policy or in relevant parts of the website.

We may use your personal information to:

(a) administer the website;

(b) improve your browsing experience by personalising the website;

(c) enable your use of the services available on the website;

(d) send to you goods purchased via the website, and supply to you services purchased via the website;

(e) send statements and invoices to you, and collect payments from you;

(f) send you general (non-marketing) commercial communications;

(g) send you email notifications which you have specifically requested;

(h) provide third parties with statistical information about our users – but this information will not be used to identify any individual user; and

We will NEVER without your express consent provide your personal information to any third parties for the purpose of direct marketing.


Disclosures

We may disclose information about you to any of our employees, officers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes as set out in this privacy policy. In addition, we may disclose your personal information:

(a) to the extent that we are required to do so by law;

(b) in connection with any legal proceedings or prospective legal proceedings;

(c) in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk);

(d) to any person who we reasonably believe may apply to a court or other competent authority for disclosure of that personal information where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure of that personal information

Except as provided in this privacy policy, we will NOT provide your information to third parties.



International data transfers

Images/information we have from your booking may be stored in other countries that provide a online cloud backup service, this enables us to provide you a secure backup service. Information which you provide may be transferred to countries (including the United States) which do not have data protection laws equivalent to those in force in the European Economic Area. We cannot prevent the use or misuse of such information by others.


Security of your personal information

We will take reasonable precautions to prevent the loss, misuse or alteration of your personal information.

Of course, data transmission over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.

We always make sure that computers/external backups are securely encrypted, IT security/websites updated and best practices are always adhere to.


Policy amendments

We may update this privacy policy from time-to-time by posting a new version on our website. You should check this page occasionally to ensure you are happy with any changes.


Your rights

You may instruct us to remove or provide you with any personal information we hold about you. Provision of such information will be subject to:

(a) the payment of a fee (currently fixed at £10.00); and

(b) the supply of appropriate evidence of your identity (for this purpose, we will usually accept a photocopy of your passport certified by a solicitor or bank plus an original copy of a utility bill showing your current address).

(c) Any information we may hold can be removed upon request, via contact by email.


You may instruct us at anytime not to process your personal information to a online cloud back up service, or a private password protector online gallery by contacting the photography via email or by selecting the option on the booking form/contract.


The Photographer reserves the right to amend these Terms and Conditions without prior notice
